These Terms of Use apply when you use yop-poll.com or store.yop-poll.com (the “websites”) and when you buy or use YOP Poll Pro. Please read them before you buy. By placing an order, you agree to them.
1. Who we are
The websites and YOP Poll Pro are provided by Nechifor Dorel PFA, VAT ID RO31493545, registered address Fundac Margareta Baciu 12, Iași, Romania (“YOP”, “we”, “us”). Contact: [email protected].
2. Using the websites
You may use the websites to learn about our products, download YOP Poll, read our guides and buy YOP Poll Pro. You must not misuse them, for example by trying to break their security, overload them, scrape them in bulk or use them to send spam or malware.
The texts, images, logos and other content on the websites belong to us or are used with permission. You may not copy or republish them without our written permission, except for short quotes with a link back to us.
3. YOP Poll Pro plans
YOP Poll Pro is sold as a yearly subscription. Each plan gives you a licence key you can activate on a set number of websites:
- Personal: 1 website
- Business: up to 5 websites
- Agency: unlimited websites, including client websites you build or manage
While your subscription is active, your licence gives you access to Pro updates and to Pro support by email. You can move a licence from one website to another by deactivating it on the first one. Licence keys are for you (or, on the Agency plan, your clients’ websites) and must not be shared publicly, resold or published.
4. Prices, taxes and payment
Prices are shown on the pricing page in your local currency (EUR, GBP or USD) based on your location. VAT or similar taxes are added where the law requires, based on your billing country. Business customers in the EU who give a valid VAT number may be invoiced without VAT under the reverse-charge rules.
Payments are processed securely by Stripe or PayPal. Your order is confirmed once the payment succeeds, and you then receive your download link and licence key on screen and by email.
5. Automatic renewal and cancellation
Your subscription renews automatically every year at the then-current price for your plan, using the payment method you used to buy it, until you cancel. We will email you before each renewal. If the price changes, we will tell you in advance, and you can cancel before the renewal date.
You can cancel at any time from your account page, which is linked in your receipt email, or by emailing [email protected]. Cancelling stops future renewals; you keep updates and support until the end of the period you already paid for.
If your subscription ends, YOP Poll Pro keeps working on the websites where it is installed. You just stop receiving updates and support. You can renew at any time to get them back.
6. 30-day money-back guarantee
If you are not happy with YOP Poll Pro, email [email protected] within 30 days of a purchase or a renewal, with your order reference, and we will refund that payment in full. You don’t have to give a reason. Refunds go back to the original payment method, usually within 5–10 business days. When a payment is refunded, the licence key for it is deactivated, and you should remove Pro from your websites.
EU consumers: YOP Poll Pro is digital content delivered immediately. When you buy, you ask us to deliver it right away and acknowledge that you lose the 14-day right of withdrawal once the download or licence key is provided. Our 30-day money-back guarantee still applies and gives you more time than the legal withdrawal period.
7. Support
Pro support is provided by email at [email protected] while your subscription is active. It covers installing, setting up and using YOP Poll Pro, and fixing problems in the plugin. It does not cover custom development, third-party themes or plugins, or hosting issues, though we will try to point you in the right direction. We aim to reply within 24 hours.
8. Your responsibilities
You are responsible for the websites where you install YOP Poll and YOP Poll Pro, including keeping backups, keeping WordPress up to date, and how you collect and use your visitors’ votes and data, including telling them about it in your own privacy policy.
9. Warranty and liability
We work hard to make YOP Poll reliable, but software can have bugs and can be affected by other plugins, themes and hosting setups. We provide the plugins “as is” and do not guarantee they will be error-free or meet every need. Please test on a staging site and keep backups.
As far as the law allows, we are not liable for indirect or consequential losses, such as lost profits, lost data or business interruption, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law, such as for fraud or gross negligence, or affects your mandatory rights as a consumer.
10. Suspension
We may deactivate a licence key that is shared publicly, resold, used on more websites than its plan allows, or bought with a fraudulent or reversed payment. We will contact you first when we reasonably can.
11. Privacy and cookies
How we handle personal data is explained in our Privacy Policy and Cookie Policy.
12. Changes to these terms
We may update these terms. The version in force when you place an order applies to that order. For renewals, we will email you about significant changes before they apply, and you can cancel if you don’t agree.
13. Governing law and disputes
These terms are governed by Romanian law. Courts in Iași, Romania, have jurisdiction, except that if you are a consumer you keep the protection of the mandatory laws of the country where you live and can bring a claim in your local courts.
